"Ce document s’intègre dans une série d’études qui, avec une perspective de droit comparé, visent à faire une présentation des principes d’égalité et de non-discrimination dans différents États. Après avoir expliqué la normative et la jurisprudence d’application, le contenu, les limites et la possible évolution de ces principes sont examinés. La présente étude a pour objet le cas de la Belgique. Cette étude retrace premièrement l’évolution de la reconnaissance du principe d’égalité et de non-discrimination en Belgique depuis 1831. Dans un second temps, il présente de la manière la plus exhaustive possible la législation belge en matière de lutte contre la discrimination. Troisièmement, l’étude aborde de façon plus sélective la jurisprudence ambitieuse de la gardienne du principe d’égalité et de non-discrimination, à savoir la Cour constitutionnelle. Quatrièmement, le rapport décrit la réception en droit belge du concept de la discrimination positive né Outre-Atlantique. Enfin, quelques réflexions conclusives sont exposées."

"With the United Kingdom’s departure from the European Union, it is appropriate to reflect on the future social pathways now open to the European Union, made more possible perhaps by the UK’s exit. For example, could Brexit result in an EU in which considerations of social citizenship and rights are elevated up the agenda in Brussels? Could the EU’s focus hitherto on ever-closer economic union and international competitiveness be shifted towards the European Pillar of Social Rights so as to strengthen it, make it more tangible in citizens’ lives and central to a renewed EU agenda? A reinvigorated social Europe may yet arise from the Covid-19 pandemic and its tragic consequences owing to a widespread, recovered recognition, not only of the state’s positive role in managing such crises, but of how it can play a decisive, transformative role in our lives for the better. This book correctly emphasises the need to place the future of social rights in Europe front and centre in the post-Brexit debate, to move on from the economistic bias that has obscured our vision of a progressive social Europe. I welcome, too, the inclusion of chapters examining the consequences of Brexit on Irish-British relations, as well as its socio-economic implications for households and families, and the complexities of migration within and beyond the EU—all issues that were regrettably overlooked in the pre-Brexit, rancorous debate. New ideas are now available—ideas based on equality, universal public services, equity of access, sufficiency, sustainability—that will allow for a social Europe embedded in an alternative paradigm of social economy within ecological responsibility, now so urgently desired across the streets of Europe. "Until the start of 2020, the EU had been benefiting from continued economic growth and record-high employment, which lead to widespread improvements in the social situation in Europe. However, the period of steady improvement came to an end in the spring of 2020, when the COVID-19 pandemic swept across Europe, leading to unprecedented disruptions in economic, employment and social conditions. The report of the Social Protection Committee provides an overview of the decisive action taken by Member States to protect employment, income and access to services through a variety of measures. However, in spite of the important measures adopted, unemployment in the EU is rising and there is a significant risk of widening economic and social disparities between and within the Member States. In this context, the report highlights that measures to address the longer-term socio-economic impacts of the pandemic may still need to be combined with targeted containment and support measures in the short term. Member States should continue pursuing their reform agendas, addressing also the gaps unveiled by the current crisis, and enhance the resilience of social protection systems, thus underpinning well-being and social cohesion in the longer-term. The European Pillar of Social Rights should continue to guide Member States’ reform efforts and its principles should continue to be systematically implemented."

Towards a European minimum income

"The general term "guaranteed minimum income" (GMI) actually covers a wide variety of schemes that have
developed over time within the social protection systems established by the EU Member States. This report
summarises the various schemes currently in place in Europe, and looks at the feasibility of introducing a
European instrument relating to non-contributory minimum income schemes aimed at people of working
age who are fit for work. It thus does not cover minimum incomes for specific categories (the elderly, etc.)
or minimum wages, which are organised and managed by the social partners, although they may be
relevant to discussions of certain elements of GMI schemes.
A study of this kind involves teasing out a complex tangle at European level. There is considerable variation
within the EU with regard to the organisation and purpose of GMI schemes, as – in common with many
social protection matters – competence in the field rests primarily with the States, or in some cases
